The organization is looking for a legal advisor to hold the crucial role of complementing our current package of services by strengthening reference and counter reference, as well as rendering social justice to referred cases of abuse and sexual violence perpetuated against children.
Moreover, this legal adviser would help review and provide insight on the legal aspects of our project.
He/she will offer strategic guidance and advice to help ensure legal conformity.
Fonctions
Anticipate and identify legal issues, as well as provide legal counsel and guidance to the institution on all legal matters relevant to our project, including Institutional law, policies, procedures, rules, and regulations, and laws pertaining to child protection, labor law, other laws and regulations that may be related to our current activities.
Draft, review and approve policies, procedures and legal documents, ensuring compliance to laws and regulations; research legal issues and recommend revisions as necessary.
Ensure the representation of the institution in judicial and administrative proceedings, and in negotiations with other agencies.
Work with the project’s Faith-Based and Community Initiative program manager to cultivate and leverage relationships with faith-based and community organizations, as well as entities involved in social justice, including Brigade de Protection des Mineurs (BPM), and Institut du Bien-Être Social et de la Recherche (IBESR) in Haiti.
Conduct research on child abuse in Haiti in order to provide support for identified cases, from reference to counter-reference.
Strengthen links with USAID implementing partners with expertise in the justice sector or child protection.
Develop strong referral mechanisms to link vulnerable youth to appropriate law enforcement, as well as existing legal and social protection entities. This will include referring them to the project’s OVC services.
Establish memorandum of understanding and referral mechanisms with human rights organizations which can offer legal assistance to vulnerable children and youth exposed to violence.
Meet with the police, judges and other legal actors to present this program and ensure their full support when referring to child protection cases; develop strategies to ensure basic legal rights of children/victims are met.
This could include the creation and coordination of a steering committee for legal assistance to children, composed of members from law enforcement, judges, lawyers, faith-based and human rights organizations.
Seek and provide support to civil society involved in advocacy and awareness for human right protective services/professionals.
Support legal professional training on sexual abuse and specific approaches to ease management of pediatric cases. This may include training of university law students and faculties.
Provide training to the project staff on various legal issues.
Maintain current knowledge of changes in legislation in Haiti and internationally related to the project engagement.
Performs any other assignments given by the technical direction of the project
Qualifications Requises
BSc degree in Law or J.D. degree; experience working with victims of violence preferred.
Certified Lawyer from the Haitian Bar Association preferred; at least 2 years of experience directly related to the duties and responsibilities specified.
Proficient computer skills (e.g. Word, Excel, PowerPoint, etc.).
Excellent writing and speaking skills in French and Haitian Creole; fluency in English is preferred.
Proven experience as a Legal Counselor in Haiti and demonstrate excellent knowledge and understanding of Haitian and International Law and procedures
Demonstrated ability to create legal defensive or proactive strategies
Outstanding communication skills
Track record of accomplishing goals, evidence of the ability to consistently make good decisions through a combination of analysis, experience, and judgment; and creative solution-oriented professional.
Experience working with Government partners and religious leaders from different faiths preferred
